2.What this page does and does not cover

This page covers the website: browsing it, using the forms, and anything you upload.

It does not set the terms of any landscaping work. Those live in the written proposal or contract for your specific job, scope, materials, price, schedule, payment and any warranty. If anything on this website appears to conflict with your signed proposal, the proposal governs.

3.Estimates and quotations

Submitting a form is a request. It does not create a contract and does not oblige either of us to anything.

• Consultations, site visits and written estimates are provided free of charge and without obligation.
• An estimate is valid for the period stated on it. Where none is stated, treat it as 30 days, material prices genuinely do move.
• An estimate reflects the conditions visible at the time of the visit. Ground conditions we could not see, buried obstructions, utility conflicts or a change to the scope may require a revised price, which we will discuss with you before doing the work rather than after.
• Nothing on this website is an offer capable of acceptance, and prices are never published here.

4.Scheduling and weather

Landscaping is outdoor work. Dates given for site visits and for the work itself are our honest best estimate and are not guaranteed.

We will move a visit or a work day when the ground is saturated, when conditions would damage the property, or when it would be unsafe for the crew, and we will tell you rather than leave you waiting. Rescheduling for weather is not a breach of anything.

5.Photographs and information you send us

When you upload photographs or send us details through a form:

• You confirm you have the right to send them. That they are of a property you own or occupy, or that you have permission from whoever does.
• You give us permission to use them for the purpose you sent them: understanding the site, preparing an estimate and carrying out the work.
• We will not publish your photographs, use them in marketing or show them to anyone outside the job without asking you first.
• You remain the owner of anything you send us.

Please do not upload anything containing other people, confidential material, or content you do not have the right to share.

6.Acceptable use

You agree not to use this website to send unlawful, abusive or deliberately false material, to submit forms automatically or in bulk, to attempt to gain access to systems or data you are not entitled to, or to interfere with the site's operation or security.

We may block access where we reasonably believe any of the above is happening.

7.Accuracy of site content

We keep this website current and correct as best we can, but content is provided for general information. Descriptions of services, timelines and outcomes are general and do not form part of any contract.

Photographs on this website may be illustrative rather than photographs of our own completed projects. Where that is the case we label it plainly on the page. Nothing shown should be taken as a promise of a specific result on your property.

8.Intellectual property

The design, text, layout and graphics of this website belong to us or our licensors. You may view, print and share pages for your own non-commercial use. You may not copy the content for a competing site, republish it commercially, or present it as your own.

Landscape designs, drawings and plans we produce for you remain our intellectual property until paid for in full, at which point rights transfer as set out in your proposal.

9.Third-party services and links

This website embeds a Google Map and may use Google Analytics. Those services are governed by Google's own terms and privacy policy.

Where we link to another website we do so for convenience. We do not control those sites and are not responsible for their content, accuracy or practices.

10.Disclaimer

This website is provided "as is" and "as available". We do not warrant that it will be uninterrupted, error-free, or free of harmful components, and to the fullest extent permitted by law we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement in relation to the website.

This disclaimer applies to the website. It does not limit any warranty or obligation we have given you in a signed proposal for actual work.

11.Limitation of liability

To the fullest extent permitted by Connecticut law, we are not liable for indirect, incidental, special or consequential losses arising from your use of this website, including lost profits or lost data, even if we were told such losses were possible.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, or for fraud.

12.Indemnity

You agree to indemnify us against claims, damages and reasonable costs arising from your misuse of this website, your breach of these terms, or your submission of material you did not have the right to send.

13.Governing law

These terms are governed by the laws of the State of Connecticut, without regard to its conflict of law rules. Any dispute arising from them will be handled by the state or federal courts located in Fairfield County, Connecticut, and you agree to that jurisdiction.

14.General

If any provision of these terms is found unenforceable, the rest continues to apply. Our not enforcing a provision on one occasion is not a waiver of it.

We may update these terms; the version published here is the one that applies, and the date at the top shows when it last changed. Continued use of the site after a change means you accept it.
